Terms and conditions of sale

1. Purpose and scope
These Terms and Conditions of Sale (the “Terms”) govern all sales concluded between:
- The seller: Fabrice Jolivet, sole trader trading as Burst Innovation Lab, whose registered office is at 37 rue Blanqui, 33110 Le Bouscat, France. SIRET: 941 912 255 00010. The site plotrek.com is published by Burst Innovation Lab. Hereinafter “Plotrek”.
- The buyer: any adult natural person placing an order on plotrek.com, hereinafter “the Client”.
The Client acknowledges having read these Terms before validating their order. Validation of the order implies full and unreserved acceptance of the Terms in force at the time of the order.
2. Products
Plotrek offers personalized works of art generated from the Client's GPS activities (trail, race, hiking routes). Three formats are offered:
- Print HD A3 (€39): high-resolution digital print on 250 g paper, A3 format (29.7 × 42 cm). Drop-shipping.
- Pen plotter A3 (€89): poster drawn on a pen plotter (Pigma Micron pens) on 250 g Bristol paper, A3 format.
- Pen plotter A2 (€149): poster drawn on a pen plotter in A2 format, delivered rolled in a tube.
Each “pen plotter” piece is unique: the minute variations inherent to plotter drawing (slight differences in ink thickness, variations in the curves) are an integral part of the work.
⚠️ Digital preview vs. paper output — important to read before buying
The configurator shows a digital preview generated on screen from the same map data as what is drawn on paper. It is not an identical reproduction of the finished product. Several factors create visible differences between the preview and the delivered piece:
- The pen plotter's pigment inks do not reproduce the screen's RGB colors. Monitor calibration varies; the paper color (cream, ivory, sand) influences the perceived output.
- The pen stroke is the central element of the product: variable thickness, slight imperfections, hatching, pen-lift marks — these are the signatures of a work drawn by hand by the machine, not defects.
- The chosen paper (Bristol, Mi-Teintes, textured art paper) imprints its own texture into the output. A poster drawn on dense grain (Médoc vinicole) has a distinct feel and look from a smooth on-screen preview.
- HD prints (Gelato drop-ship) are, for their part, printed in CMYK on 250 g paper, which also produces color differences relative to the on-screen preview. These are professional-quality prints but not calibrated to your monitor.
By placing an order, the Client acknowledges having read and understood these characteristics inherent to the pen-plotter process and to high-definition printing. The differences described above do not constitute a defect and do not give rise to a refund under the conformity guarantee (article L217-4 of the French Consumer Code), without prejudice to the right of withdrawal described in article 6.
3. Prices
Prices are stated in euros (€), all taxes included. VAT is not applicable under article 293 B of the French General Tax Code (micro-enterprise exemption scheme).
Shipping costs for physical products are €6, regardless of destination (metropolitan France, European Union and rest of the world).
Plotrek reserves the right to change its prices at any time; however, products are invoiced on the basis of the rates in force at the time the order is validated.
4. Order and payment
Payment is made online by bank card (Visa, Mastercard, American Express, CB) via the Stripe platform. All transactions are secured (TLS encryption, PCI-DSS compliance).
The order is definitively registered once payment is received. A confirmation email is sent immediately to the address provided by the Client.
5. Delivery
Physical products: production within 5 to 10 business days (A3 pen plotters are made in weekly batches). Shipped from Le Bouscat (33). Estimated delivery time:
- Metropolitan France: 2 to 5 business days
- European Union: 5 to 10 business days
- Rest of the world: 10 to 20 business days
The transport risk is transferred to the Client on delivery. The Client must check the condition of the parcel on receipt and raise any reservations with the carrier within the legal timeframes.
6. Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the Client has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give a reason.
Exception: in accordance with article L221-28-3°, the right of withdrawal does not apply to goods made to the Client's specifications or clearly personalized. As A3 and A2 pen-plotter posters are unique pieces generated from the Client's GPS data, they are not eligible for the right of withdrawal once production has started.
The Client may exercise their right of withdrawal by sending an email to hello@plotrek.com with their order number. The refund is issued within 14 days of receiving the returned product in good condition (return costs borne by the Client).
7. Guarantees
All products benefit from the legal conformity guarantee (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
In the event of a lack of conformity, the Client has 2 years from delivery to act. They may choose between repair or replacement of the product. Costs are borne by the seller.
8. Liability
Plotrek cannot be held liable for:
- defects resulting from abnormal use or use not in line with the product's purpose;
- indirect damages (loss of enjoyment, loss of opportunity, etc.);
- any delivery delay attributable to the carrier or to a case of force majeure.
9. Personal data
The processing of personal data is detailed in our privacy policy.
10. Mediation
In accordance with article L612-1 of the French Consumer Code, in the event of a dispute not resolved amicably with our customer service, the Client may refer the matter free of charge to a consumer mediator. The details of the competent mediator are provided to the Client on simple request to hello@plotrek.com.
The Client may also use the European online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr.
11. Applicable law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have sole jurisdiction.
